The Process Steps for Filing Complaints
A. Complaints in cases of infringement of trademarks, and deceit and fraud.
Step (1)- Provide complete documents as follows:
- A complaint letter
- A copy of the trademark registration
- An authenticated legal authorization to file a complaint
- In case the complainant is a law firm, original and fake samples of the items that are the subject of the complaint with a list of the main similarities between the two trademarks and the discrepancies between the samples - the original and the fake ones,
- A list of the names and addresses of the violators including phone numbers.
Step (2)- Payment of administrative study fees Step (3)- Once the complaint is accepted, arrangement for
inspection will be made after the payment of inspection fees.
B. Complaints in cases of infringements of commercial agencies:
Step (1) – Complaint letters are to be addressed to the Ministry of Economy and Commerce.
Step (2) – The Ministry on its part will inform the Dubai Economic Department (DED) and set inspection date.
Step (3) – The complainant pays complaint and inspection fees to the Dubai Economic Department, not the Ministry, but the inspection is undertaken by both the latter and the DED.
Step (4) – Temporary attachment of the goods and transfer of the case to the Ministry. In case no legal action is taken by the Ministry within 30 days from the date of attachment, the goods are to be released by law. (The complainant can check with the Ministry to find out about the result of his complaint, not the Dubai Economic Department). In case of a complaint pertaining to infringement of a commercial agency, the complainant is requested to present the following documents to the Ministry of Economy and Commerce - Dubai:
- A complaint letter.
- A Certificate of Registration of a Commercial Agency.
- The purchasing invoice to prove the infringement.
